Policy 01

Purchase, Delivery & Refund Terms

Products and prices

The products sold through this website are downloadable teaching resources and, where stated, accompanying audio recordings. Product descriptions identify the principal contents of each resource. All prices are one-off amounts displayed in Australian dollars (AUD). GST is not charged.

Payment

Payments are processed securely by Stripe. The Sound Sculptor does not receive or store your full card number. Your order is accepted when Stripe confirms successful payment. Your bank or card provider may separately apply currency-conversion or international transaction fees.

Digital delivery

After successful payment, the website provides access to the purchased download. Delivery is normally immediate, and a private download link is also sent to the email address used at checkout. The link expires for security, but a fresh one can be requested from the download recovery page. Internet, browser or service interruptions can delay access. If your download does not arrive or cannot be opened, email thesoundsculptor@gmail.com with the purchaser’s name, email address and order details. We will verify the purchase and restore access or provide a replacement file.

Change-of-mind requests

Because these are digital products supplied immediately and cannot be returned, refunds are not ordinarily offered where a purchaser simply changes their mind, no longer needs the resource, or accidentally purchases a resource they already own. Please review the title, description and price before paying. We will, however, correct duplicate charges and consider exceptional circumstances fairly.

Problems with a resource

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. If a resource is faulty, incomplete, materially different from its description, or cannot reasonably be used for its stated purpose, contact us. Depending on the circumstances and applicable law, the remedy may include a corrected file, replacement access or a refund.

Corrections and future additions

Minor corrections may be made to a resource after purchase. A purchase includes only the files and inclusions described at the time of purchase. Future resources or substantial additions are not included unless the product description expressly says otherwise.

Contact and disputes

Please raise any delivery, billing or product concern first by emailing thesoundsculptor@gmail.com. We will try to resolve it promptly and reasonably. These terms are governed by the laws applying in Western Australia, Australia, without limiting any mandatory consumer rights available elsewhere.

Policy 02

Classroom-Use Licence

Licence granted

Each purchase grants the individual purchaser a non-exclusive, non-transferable, continuing licence to use the purchased resource for their own teaching. Copyright and all other intellectual property rights remain with Michael Pignéguy and any other credited rights holders.

You may

• Use the resource with classes and ensembles you personally teach or direct.
• Print or photocopy worksheets and parts for those students.
• Display the resource and play included audio during your own lessons and rehearsals.
• Share files with your current students through a password-protected school learning system, provided access is limited to those students and removed when no longer needed.
• Adapt lesson delivery, instrumentation or classroom activities to suit your students.
• Use the resource in non-commercial school performances and presentations you direct.

You may not

• Forward, copy or share the original files with another teacher, school or organisation.
• Upload any part of the resource or audio to a public website, open drive, social platform or public video.
• Sell, sublicense, redistribute, republish or include the resource in another product or resource pack.
• Remove copyright notices, claim authorship, or use the files to train a commercial generative-AI system.
• Use included recordings as standalone commercial music, advertising audio or production-library content.

Colleagues and school-wide use

This is a single-educator licence. A colleague who wants to use the resource independently needs their own licence. For department-wide, campus-wide, multi-school or commercial workshop use, contact thesoundsculptor@gmail.com to arrange permission.

Performances and third-party rights

This licence permits classroom and non-commercial school performance use of the resource itself. It does not replace any music, venue, broadcast, recording or public-performance licence that a school or organiser may otherwise require. Credit Michael Pignéguy and the resource title where practical.

Breach

The licence ends if its material conditions are breached and the breach is not corrected after notice. Ending the licence does not affect rights or remedies that arose before termination.

Policy 03

Privacy Policy

Information we collect

When you purchase or contact us, we may collect:

• Your name and email address.
• Any limited billing details Stripe requires for the selected payment method.
• Purchase details, including the resource, amount, currency and Stripe transaction identifiers.
• Messages and other information you provide when requesting support.
• Basic technical and security information such as IP address, browser details and server logs.

Payment-card information is collected and processed by Stripe. The Sound Sculptor does not receive or store your complete card number or security code. We do not ask Stripe Checkout to collect a full billing address unless it is necessary for the selected payment method.

How information is used

We use personal information to:

• Process and verify payments and deliver purchased resources.
• Provide customer support, restore access and resolve disputes.
• Prevent fraud, misuse and unauthorised distribution.
• Maintain transaction, accounting and legal records.
• Improve the reliability and security of the website.

We do not sell personal information or use purchase details for unrelated advertising. Marketing email will only be sent where permitted and where any required consent has been obtained.

Service providers and overseas processing

We use service providers including Stripe for payment processing, Cloudflare for website hosting, security, order records and file delivery, and Resend for transactional delivery and recovery emails. These providers may process information in Australia and other countries under their own privacy and security arrangements. We may also disclose information when required by law, or to professional advisers where reasonably necessary.

Storage and retention

We take reasonable steps to protect information from loss, misuse and unauthorised access. Purchase and support records are retained only for as long as reasonably required for delivery, accounting, legal, fraud-prevention and dispute-resolution purposes, then deleted or de-identified where practicable.

Cookies and external services

The site does not currently use advertising or behavioural-analytics cookies. Stripe may use necessary technologies on its hosted checkout, and Cloudflare may process technical information to provide and secure the website. Fonts are supplied through Google Fonts, which may receive basic request information such as an IP address when the fonts are loaded.

Children

The resources are intended for purchase by adult educators and schools. We do not knowingly request personal information directly from children through this website.

Access, correction and privacy questions

To ask what personal information we hold about you, request a correction, raise a privacy concern or request deletion where applicable, email thesoundsculptor@gmail.com. We may need to verify your identity before acting on a request and may retain information where legally required.

Changes to this policy

This page may be updated when the website, providers or legal obligations change. The effective date at the top of the page identifies the current version.
